1. Acceptance of Terms

These Terms of Service are between you and MeasureLab ("we", "us", "our", or "the Company"). By accessing or using MeasureLab ("the Service") at measurelab.app or related domains, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. We may update these terms from time to time; continued use after changes constitutes acceptance of the updated terms.

2. Description of the Service

MeasureLab is a web-based application for live microscope measurements. It allows you to connect compatible devices (e.g. USB microscopes), view live feeds, capture images, calibrate measurements, and perform distance and area measurements. The Service may offer free and paid tiers; features and limits may vary by plan.

3. Account and Eligibility

You may need to create an account to use certain features. You must provide accurate information and keep your account secure. You must be at least 16 years old (or the age of consent in your jurisdiction) to use the Service. You are responsible for all activity under your account.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these terms. You must not:

Use the Service in any way that violates applicable laws or regulations
Attempt to gain unauthorized access to the Service, other accounts, or our systems
Interfere with or disrupt the Service or its infrastructure
Upload, store, or share content that is illegal, harmful, or infringes others' rights
Use the Service to build a competing product or copy its functionality
Scrape, automate access, or overload the Service beyond normal use

We may suspend or terminate your access if we reasonably believe you have violated these terms.

5. Your Content and Data

You retain ownership of the content you create and upload (e.g. images, measurements, projects). By using the Service, you grant us a limited license to store, process, and display that content as necessary to provide and improve the Service. You are responsible for ensuring you have the right to use and store such content. We do not claim ownership of your data. Our collection and use of personal data are described in our Privacy Policy.

6. Subscriptions and Payments

If you subscribe to a paid plan, you agree to the applicable subscription terms and payment conditions. Fees are as stated at the time of purchase. Renewals are automatic unless you cancel before the end of the current billing period. We may change pricing or plans with reasonable notice; continued use after a change may constitute acceptance. All payments are processed securely through our payment provider, Paddle. Refunds are governed by Section 7 below.

7. Refund Policy

We want you to be satisfied with MeasureLab. The following refund terms apply to paid subscriptions:

You may request a full refund within 14 days of your initial purchase if you are not satisfied with the Service, with no questions asked.
Refund requests after the 14-day period are evaluated on a case-by-case basis and may be granted at our discretion (for example, in the event of a billing error or extended service outage).
If you cancel your subscription, you will not be charged for future billing periods. You retain access to Pro features until the end of your current paid period. No partial refunds are issued for unused time within a billing cycle.
Refunds are processed through Paddle, our payment provider, and will be returned to your original payment method. Processing times depend on your bank or payment provider.

To request a refund, contact us at info@measurelab.app with your account email and a brief reason. We aim to respond within 2 business days.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or suitable for any particular use (e.g. medical, legal, or regulatory compliance). Measurement results depend on calibration and device quality; you are responsible for verifying accuracy for your use case.

9. Limitation of Liability

To the maximum extent permitted by law, we and our affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or business opportunity, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim (or, if you have not paid, zero). Some jurisdictions do not allow these limitations; in such cases, our liability is limited to the fullest extent permitted by law.

10. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access or the Service itself with or without notice, for any reason, including breach of these terms. Upon termination, your right to use the Service ceases. We may retain or delete your data in accordance with our Privacy Policy and applicable law.

11. General

These terms are governed by the laws of the jurisdiction in which we operate, without regard to conflict of law principles. Any disputes shall be resolved in the courts of that jurisdiction. If any provision is held invalid, the remaining provisions remain in effect. Our failure to enforce a right does not waive that right. These terms constitute the entire agreement between you and us regarding the Service.
